FACILITIES USE AGREEMENT
In consideration of the Berkeley Walk Community Association (the “Association”) allowing the non-exclusive use of the swimming pool (hereinafter “Pool”) and other recreational facilities located in the Berkeley Walk Community (Pool and other facilities collectively referred to hereinafter as “Facilities”), I, the undersigned, agree as follows:
- I agree to reserve the Clubhouse of Berkeley Walk Community Association under the terms and conditions set forth below.
- I understand that continued use of the Clubhouse after the hours for which it has been reserved will constitute a breach of this Agreement and will result in forfeiture of my deposit.
- I will submit two (2) checks: one check for the rental fee amount $100 and one check for the damage deposit $100. Both checks are due and payable upon submission of this Agreement. I understand that the Association will retain the rental fee amount $100 and that the balance of $100.00 will be returned to me when I return the key if the Clubhouse is in substantially the same condition as when I received the key. I further understand and agree that, if the Association deems it necessary, this deposit will be used to pay for cleaning costs and any and all damages to the Clubhouse, its contents, or any other portion of the property occurring while I was in possession of the key. I understand that any charges made against my deposit will be explained. If the amount of charges exceeds the amount of my deposit, I agree to pay the Association the full cost of all repairs within ten (10) days of receipt of a written explanation of the damages and a bill from the Association for such repairs. I agree that all deposits, fees and expenses that may be due under this Agreement shall be considered an assessment and constitute a lien against my property and shall be fully collectible as such as provided for in the Association’s Declaration and Bylaws. I agree that my responsibility for any damage occurring while I was in possession of the key does no cease upon return of the key.
- I understand that children under the age of 14 are not allowed to use the Pool without an adult in attendance, that persons 14 to 18 years of age are not allowed to use the Pool after 9:00 p.m. without an adult in attendance, and that nobody is allowed in the pool unless at least one other person age 14 or older is present.
- I assume all responsibility, risks, liabilities and hazards incident to my use of the Facilities and hereby release and forever discharge the Association and their officers, directors and employees, agents and members, past, present and future, from any and all claims, costs, causes of action and liability for personal injury or death and damage to or destruction of property arising from my use of the Facilities.
- I agree to indemnify and hold harmless the Association and their officers, directors and employees, agents and members, past, present and future, from any and all claims, costs, causes of action and liability (including but not limited to attorney’s fees) resulting from negligence or otherwise for an injury, to any person or property, suffered by me, my family members, employees, agents, guests, invitees or any member of the Association or any other person which arise from or are in any way related to my use of the Facilities.
- I assume all responsibility for the actions and behavior of all persons present at the Facilities at my request or invitation or as a result of this Agreement and agree to be personally responsible for causing all such persons to comply with the rules and regulations concerning Facilities use.
- I acknowledge having received a copy of the Berkeley Walk Community Swimming Pool Rules and Regulations, the Berkeley Walk Community Tennis Court Rules and Regulations, and the Berkeley Walk Community Clubhouse Rules and Regulations; have carefully read and understand them; and agree to abide by them.
- I understand that only owners of property in the Berkeley Walk subdivision are members of the Association, even though other parties may be granted the right to use the Facilities.
- I agree that following my event I will restore the Clubhouse, contents, and related facilities to substantially the same condition they were in at the time I received the key.
- I understand that my reservation of the Clubhouse on the aforementioned date will not be confirmed nor will this Agreement be binding until such time as this Agreement has been executed by the Association or its designated representative.
- I understand that bouncy houses/inflatables are not allowed in or around the Clubhouse, parking lot, or pool area.
- I have carefully read and understand this Clubhouse Application For Reservation Agreement and the Berkeley Walk Community Clubhouse Rules And Regulations and agree to be bound by their terms.
